Endorsements/Disqualification and Special Reasons

If the Court accepts that there are ‘Special Reasons’ for the commission of an offence, it has discretion as to whether to refrain from disqualifying, or endorsing a driver’s licence. Special reasons do not technically amount to a defence, but may have an impact on the sentence the Court imposes.

With offences carrying penalties of obligatory disqualification, the Courts have the power to shorten the period of disqualification or not to impose one at all if they consider that there is special reason not to do so.

Obligatory endorsements are imposed for a number of offences including speeding, using a hand-held mobile phone whilst driving and driving without insurance.

The Court will take into account factors relating to the commission of the offence and not the effect a disqualification/endorsement will have on the driver.

Examples of Special Reasons include medical emergencies, the defendant being misled as to the commission of the offence, shortness of distance driven and the spiking of drinks.
