Dangerous driving is a more serious offence than careless driving. Dangerous driving is when a driver's standard of driving falls far below what would be expected of a competent and careful driver and it would be obvious to a competent, careful driver that driving in that way would be dangerous.
The offence can come into play either when the driver is driving in a dangerous manner or alternatively if they are driving a vehicle which is in a dangerous condition. If the offence involves the latter then the Court will take into account whether the driver should be expected to know that driving a vehicle in its condition would be dangerous.
The penalties for dangerous driving are an unlimited fine (if tried in the Crown Court) and obligatory disqualification for 12 months with a compulsory extended driving test. In addition, the Court may order that a prison sentence of up to 2 years is appropriate. This is increased to 14 years if the death of another person results.
There is a fine line between careless and dangerous driving but the penalties are very different. It is therefore extremely important if you are in receipt of an NIP or summons for such offences, you obtain specialist legal advice. Often we are able to reduce the seriousness of the charge against the driver.
